ATTENTION: PLEASE READ THESE TERMS OF USE CAREFULLY. BY DOWNLOADING, INSTALLING, USING, OR ACCESSING THE STYLIX AI APPLICATION, YOU AGREE TO THE FOLLOWING TERMS OF USE AND THE REFERENCED DOCUMENTS. IF YOU DO NOT AGREE TO THESE TERMS, DO NOT USE THE APPLICATION AND IMMEDIATELY UNINSTALL ITFROM YOUR DEVICE.

These Terms of Use ("Terms") constitute a legal agreement between Digital Garden Teknoloji Anonim Şirketi ("DigitalGarden", "we", "us" or "our"), a Turkish company head quartered in Istanbul/Turkey, and you ("User" or"you"), who uses the Stylix AI artificial intelligence-based fashion style assistant mobile application ("Application").

1. Subject and Scope of the Agreement

‍These Terms govern the rights and obligations of the User regarding the download, installation, access, and use of the Stylix AI Application. The Application is a service developed by Digital Garden that enables Users to receive artificial intelligence-based support regarding fashion styling ("Services"). These Terms may not apply to other products or services offered by Digital Garden, but they contain general provisions for Digital Garden Services in connection with the Application.

‍2. Acceptance

‍By downloading, installing, using, or accessing the Application, you represent and warrant that you have read, understood, and accepted these Terms and all additional documents and policies referenced here in (including the Privacy Policy). If you do not accept these Terms, you do not have the right to use the Application. Your continued use of the Application means that you accept the current Terms.

‍3. User Criteria

‍By accepting this Agreement, you confirm that you are at least 18 years old, or if you are under 18 or do not have the legal capacity to enter into a contract in your country of residence, that you are using the Apple App Store and/or Google Play with the consent of your parent or legal guardian. You also confirm that you have read, understood, and agree to be bound by this Agreement in its entirety. Please note that to use Google Play, you must have a valid Google account and comply with any applicable age restrictions. You must also comply with any additional age restrictions that may apply to special content or features on Google Play. You may only use the App with the consent and supervision of your parent or legal guardian. Parents and legal guardians are responsible for their children’s use of the App and any consequences that may arise. In certain jurisdictions (for example, theEuropean Economic Area under the GDPR), minors under 16 may not be legally permitted to use the App. By using the App, you confirm that you comply with any applicable age restrictions.

‍4. Description of Services

‍'Services' refers to the functions of the Stylix AI application that use artificial intelligence to generate responses and content based on user input (text, documents, or images). Share content such as text, sentences, records, information, questions, queries, links, documents, audio recordings, images, photographs, visual and audio recordings, sound recordings, graphics, materials and other data("Input") with or through our Services, and obtain content such as text, sentences, answers, links, documents, images, photographs, visual and audio recordings, sound recordings and other data produced, generated or provided in response to the Services ("Output") (Input and Output together referred to as "User Generated Content"). By using the Services to share or obtainUser-Generated Content, you grant us a non-exclusive, irrevocable, fully-paid, royalty-free, perpetual, sublicensable, transferable, worldwide license to store, use, communicate to the public, reproduce, modify, create derivative works from, record, sublicense (at different levels), translate, transmit, publish, publicly display or otherwise exploit such User-Generated Content in any format, by any means and through all technology now known or later developed, without any notice, permission, fee or additional compensation toyou or any third party.

‍5. User Account and Registration

‍All users wishing to use the application must create an account and complete the registration process before accessing the application. No functions or services can be used until registration is complete. You are responsible for keeping your account information confidential and secure. If you become aware of any unauthorized use of your account, you must notify Digital Garden immediately. Digital Garden reserves the right to suspend or terminate your account if it suspects that you have provided inaccurate, out-of-date, or incomplete information.

‍6. Grant of License

‍Provided that you comply with these Terms, Digital Garden grants you a limited, non-exclusive, non-transferable, non-sublicensable and revocable license to download, install, access and use the Stylix AI App on a mobile device that you own or control, for your personal and non-commercial use only. This license does not transfer ownership of the App to you.

7. User Obligations and Prohibited Activities

‍By using the App, you agree to comply with the following obligations and refrain from the following activities:

• Not to use the app to create, upload, or share any content that is unlawful, harmful, threatening, harassing, libelous, defamatory, hateful, discriminatory, or otherwise objectionable.
• Not to violate the intellectual property rights, privacy rights, or other legal rights of third parties.
• Not attempting to derive the source code, reverse engineer, modify, or create derivative works of the application.
• Not to interfere with the operation of the Application or bypass or disable security systems.
• Not to upload or disseminate viruses, malware, or other material that may harm the application.
• Do not send spam or engage in unsolicited advertising.
• Do not use the Application to develop products or services that compete with the Application.
• Do not use the output to mislead anyone into believing it was created by a human.
• Do not use the output to make significant decisions that may have a legal or material impact on individuals.
• Not to use the Application or Services for illegal or immoral purposes.

In case of non-compliance with this clause, Digital Garden reserves the right to terminate these terms and conditions and take legal action.

‍8. Intellectual Property Rights

‍The Stylix AI application, including all associated software, designs, graphics, logos, trademarks, and other content, is the exclusive property of Digital Garden Teknoloji Anonim Şirketi and is protected by relevant laws. All rights not expressly granted to you in these Terms are reserved by Digital Garden. Users are strictly prohibited from copying, modifying, or extracting the source code or creating derivative versions of the application. Users are solely responsible for ensuring that any User Generated Content (including Input and Output) provided to or created through the Application does not infringe the intellectual property rights of third parties. The user grants Digital Garden a broad license to use the input provided to operate and develop the application. Digital Garden respects the rights of copyright owners and reserves the right to terminate users' access who infringe copyright or publish inappropriate content. The user agrees to compensate Digital Garden for any damages incurred due to intellectual property violations resulting from the user's content.

‍9. User Generated Content

‍The input you provide is yours. However, by uploading or transmitting it to the app, you grant Digital Garden a worldwide, non-exclusive, irrevocable, fully paid, royalty-free, perpetual, sub-licensable and transferable license to use the user-generated content for the limited purpose of operating, improving, troubleshooting, debugging, maintaining and customizing the app (including machine learning) and developing new features. This license includes the rights to store, use, communicate to the public, reproduce, modify, create derivative works from, publish, and otherwise exploit the content.The output generated by the application is based on artificial intelligence algorithms. You acknowledge that the output may be in accurate, incorrect, or misleading. Digital Garden makes no representations or warranties as to the accuracy, correctness, or suitability of the output.The output does not constitute a recommendation or opinion of Digital Garden.You use the Output entirely at your own risk. Digital Garden cannot pre-screen or monitor user-generated content, but reserves the right to do so. You acknowledge that you do not expect privacy when submitting any content.

‍10. Third Party Services and Content

‍The App may contain links to or integrate with third-party websites, services, advertising or content. These third parties have their own terms of use and privacy policies that apply. Digital Garden has no control over, and is not responsible for, these third-party services or content. Your use of third-party services or content is entirely at your own risk.

‍11. Privacy

‍For information about how Digital Garden collects, uses, and discloses your personal data, please review our Privacy Policy. The PrivacyPolicy is an integral part of these Terms.

‍12. In-App Purchases and Payments

‍The app may offer in-app purchases or subscription options for certain features or additional services. These purchases and payments are typically processed via third-party platforms, such as the Apple App Store or Google Play. These platforms are subject to their terms and conditions.Subscriptions may automatically renew. Your cancellation rights may vary depending on your country of residence and the platform's policies. DigitalGarden is not responsible for payments made through third-party platforms or for these platforms' policies. For purchases made directly through DigitalGarden, the right of withdrawal generally does not apply, unless local law states otherwise.

‍13. Updates and Changes

‍Digital Garden is constantly improving the app and its services. Therefore, we reserve the right to amend the app and these terms and conditions at any time. Any changes to the Terms will be notified within the app or on our website. Your continued use of the app after the revised terms have been posted will mean that you accept the changes. Digital Garden may require you to update the app and may stop supporting previous versions.

‍14. Disclaimer of Warranty

‍To the extent permitted by applicable law, the Stylix AI App and Services are provided on an 'as is', 'with all faults' and' as available' basis. To the fullest extent permitted by applicable law, Digital Garden disclaims all warranties, whether express or implied, statutory or otherwise (including, but not limited to, warranties of merchantability, fitness for a particular purpose, and non-infringement). Digital Garden does not guarantee that the App will meet your requirements or be free from interruption, errors, security issues, or reliability problems. Digital Garden accepts no liability or responsibility for any material damage of any nature arising from your access to or use of the Digital Garden Apps, including, but not limited to: - unauthorized access to, or use of, our secure servers and/or any personal and/or financial information stored therein;- any interruption or cessation of transmission toor from the Digital Garden apps or servers;- any bugs, viruses, Trojan horses, or similar that may be transmitted to or through the Digital Garden apps by any third party;- any errors or omissions in any content;- any loss or damage of any kind incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available via the Digital Garden apps.

‍15. Limitation of Liability

‍To the fullest extent permitted by applicable law, Digital Garden, its affiliates, licensors and partners shall not be liable for any loss of profits, loss of data, loss of goodwill or any other indirect, incidental, special, consequential or punitive damages arising from the use of, or inability to use, the App; unauthorized access; the conduct of third parties; or any other matter relating to the App. Digital Garden's total liability to you shall not exceed the amount you paid to access the app.

‍16. Compensation

‍By using the App, you agree to indemnify and hold Digital Garden, its affiliates, and all their respective officers, directors, employees and agents harmless from and against any claims, liabilities, damages, losses and expenses (including reasonable legal fees) arising from your use of theApp, your violation of these Terms or any third-party rights.

‍17. Term and Termination

‍These Terms come into effect on the date you start using the App and remain in effect until terminated by either Digital Garden or you. Digital Garden reserves the right to terminate these Terms immediately and without notice if you breach these Terms or any relevant policies, without incurring any liability for damages. If you terminate these Terms, you must cease using the App and uninstall it from your devices. The provisions that, by their nature, should remain in effect (intellectual property, limitations of liability, indemnification, etc.) will continue to apply in the event of termination.

‍18. Force Majeure

‍In all cases of force majeure, Digital Garden cannot be held responsible for failing to fulfil its obligations under this Agreement, or for late or incomplete performance.Such deficiencies will not be considered default, incomplete performance, or faulty performance, and no compensation claim will be made against DigitalGarden about them.For thisAgreement, the term 'force majeure' refers to any event beyond the reasonable control of the affected party that cannot be avoided despite reasonable care being taken by Digital Garden. This includes, but is not limited to, natural disasters, riots, uprisings, turmoil, wars, communication outages, infrastructure and internet network failures, energy outages, mobilizations, strikes, fires, explosions, terrorism, cyber-attacks, and adverse weather conditions.

‍19. Applicable Law and Jurisdiction

‍This Agreement and any legal relations arising from it shall be subject to, and interpreted by, Turkish law. The Istanbul (Çağlayan) Courts and Enforcement Offices shall have jurisdiction over all actual or potential disputes arising from thisAgreement. By accepting this Agreement, you are deemed to have consented to the jurisdiction of these courts to the maximum extent permitted by law, and to have waived your right to object to such jurisdiction and venue.

‍20. Integrity of the Agreement and Divisibility

‍These Terms constitute the entire agreement between you and Digital Garden regarding your use of the Application. If any provision of these Terms is deemed invalid or unenforceable by a court of competent jurisdiction, it will be ineffective only to the extent of that invalidity or unenforceability. The remaining provisions of the Terms will remain in full force and effect.
